連結動保人士臉書挨告　法學教授不起訴

【呂志明／台北報導】擔任農委會動保諮議小組成員的台大知名法學教授李茂生，2年前在動保諮議小組第4次會議發言內容遭動保人士偷錄並PO上臉書，李要求移除被拒，索興將對方臉書的連結PO在自己臉書，結果被控妨害秘密，但台北地檢署認定證據不足，今將李不起訴。

李茂生供稱，當天會議他擔任主席，向遲到的黃姓動保人士簡述結論，對方卻偷錄他的發言並PO網，他認為在法律及道德上均不妥，請對方刪除遭拒，才將連結張貼在自己的臉書上，竟挨告妨害祕密。

李茂生表示，當天雖是閉門會議，但結論並非秘密，沒有洩密問題。北檢也認定，該次會議是為廣納專家及大眾意見而召集，並未涉及任何公務或個人穩私，屬公共議題，不構成妨害秘密，因此將李不起訴。
