搶到柔術高手　遭制伏不算強盜

宜蘭一名47歲李姓男子，日前酒後行搶1名在公車亭候車的梁姓瘖啞男子，沒想到梁男擁有高超的柔道與擒拿技術，當場使出柔道中「內腿」一式及十字擒拿法，將李男壓制在地，交給據報趕來警方處理；警方對李男進行酒測，發現酒測值高達1.11毫克，偵訊後依強盜罪嫌移送法辦。
 
宜蘭地檢署偵訊後指出，未達到使人不能抗拒之程度，僅能以強奪或恐嚇取財罪論處，不能以強盜罪相繩；因行搶的李男個頭比梁男小，且梁男長期學習柔道，輕易就將李男絆倒並壓制在地，由此可見李男行搶時雖施用強暴，但尚未達讓梁男達不能抗拒之程度，所以李男僅構成搶奪未遂罪嫌起訴。
 
警方指出，強盜罪處5年以上有期徒刑，強奪罪處6月以上5年以下有期徒刑，二者間刑期差很大，李男搶到柔道高手雖很衰，反而幸運逃過較重刑期。（潘岳／宜蘭報導）
