標題[問題] 請問車禍調解？

因為第1次遇到這種問題 不是很懂 想請教大家 我是直行車(汽車)行駛在內線車道 未超速 對方是機車 從機車道直接左轉 我雖然有緊急剎車 但還是撞上他 警察局的初步判斷 他占多數肇事責任(他7 我3) 對方是70歲的老爺爺 當時目測僅手腳輕微擦傷 最近對方申請調解 出具診斷證明腰椎骨折(但沒註明要休養多久) 包含居家看護3個月10萬 勞動力減損3個月13萬5000 精神撫慰24萬 再加上醫療單據 交通費 機車修理費等 一共要求50萬 保險公司理賠員說醫療單據才2000 精神撫慰要24萬 不成比例 另外勞動力減損部分 對方也沒證據可以證明 所以調整尚不成立 想請問大家 精神撫慰金該怎麼算比較合理呢？ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.246.71.18
