最高法院發回羅文源認祖案 要求釐清收養關係

已故台塑集團創辦人王永慶四房子女羅文源三姊弟認祖案，最高法院今天下午將全案撤銷發回更審。

最高法院表示，羅文源三姐弟雖是王永慶的血脈，但早在五十二年前他們已經開始接受羅景祺撫養。最高法院認為，羅景祺當年可能想要「收養」羅文源姐弟，卻因誤用《民法》的「認領」程序而失敗，進而可能轉化為「擬制收養」，也就是視為收養。最高法院要求高院應尊重這些過往事實的存在，所以將原判決廢棄、發回高院重新了解，重新確認羅文源跟羅家是否已經成立「擬制收養關係」，如果確認羅家收養，羅文源將無法請求王家接受他們認祖歸宗。

羅文源三姐弟在王永慶逝世後，公開表明是王永慶的親生骨肉，為了認祖歸宗，三姐弟提起民事「生父死後認領」訴訟。一、二審都判決羅文源三姐弟勝訴，全案上訴三審，最高法院今年九月還為此開庭辯論，今天將全案撤銷發回更審。
