過期原料製小泡芙　義美4人依偽造文書罪起訴

義美公司龍潭廠因涉及生產過期原料泡芙，違法使用過期大豆分離蛋白，包括翁姓課長、黃姓生產組長、黃姓品管及魏姓操作員4人，遭桃檢依偽造文書罪起訴。

起訴書裡提到，翁姓課長等人明知義美生產泡芙等商品中，操作員應按日填寫紀錄表，並完整記載名稱、批號、品項等項目，再行審核，但倪姓副總廠長及龍潭廠管理中心副理兼資材部羅副理，自99年9月至101年8月間卻多次指示底下員工使用過期的大豆分離蛋白生產小泡芙等熱銷商品，2年內就用了逾9公噸過期原料。

桃檢表示，作業員期間發現大豆分離蛋白已逾期，向翁姓課長反應，卻仍被要求將過期原料加入製品中，並且在紀錄表上寫下原料使用期限。事後翁姓課長將巧克力投料紀錄表更換，重新撰寫新的紀錄表，湮滅舊資料，因此桃檢認為課長一行人已有業務登載不實文書的意圖，建議從重量刑。
