法律保障軍法官支領勤務加給權利

國軍軍法體系已依修法內容將軍法案件全數移給司法單位，軍法官面臨無案可審的窘境，不過，依照國防部編列103年度預算案中，國防部仍為軍法人員編列勤務加給，軍法官按階級，將官與上校支領8900元、中少校支領6900元、尉官5900元、書記官則支領3200元。其中軍法官將官有70人需747萬餘元、中、少校105人需869萬餘元、尉官59人需417萬元、書記官126人需483萬餘元，總計需2516萬餘元。

軍法司表示，依照現行軍事審判法第12條規定，軍法官非依法律不得減俸、停職或免職，非得本人同意，不得調任軍法官以外職務，而軍法官調任軍法官以外職務者，其年資及待遇，仍依軍法官的規定列計。第14條也規定，軍法官因組織或編制變更而被編餘，未派新職者，仍按原階支全數薪給，並儘速指派新職。前項編餘期間不得逾1年。軍法官縱使無案可審，但支領勤務加給權利是由法律所保障。
