依據民法，定期契約未到期前或不定期契約者，一方提出解除契約時，他方得提出侵權損害賠償
勞動基準法第十五條之「提前預告」及第十六條之「預告期間」規定，即在律定勞工依此規定提出自請離職時，免除上述違約之法律追訴權
任職滿三年以上，應於三十ㄖ前，向雇主提出預告離職
預定六月十六ㄖ離職，必須於五月十六ㄖ之前，先向雇主提出預告離職。否則，未提前預告或預告期間不足，雇主就可以檢附損害清單，向法院提出侵權損害告訴，要求離職勞工賠償
