依據民法,定期契約未到期前或不定期契約者,一方提出解除契約時,他方得提出侵權損害賠償
勞動基準法第十五條之「提前預告」及第十六條之「預告期間」規定,即在律定勞工依此規定提出自請離職時,免除上述違約之法律追訴權
任職滿三年以上,應於三十ㄖ前,向雇主提出預告離職
預定六月十六ㄖ離職,必須於五月十六ㄖ之前,先向雇主提出預告離職。否則,未提前預告或預告期間不足,雇主就可以檢附損害清單,向法院提出侵權損害告訴,要求離職勞工賠償
