吉林茶行命案成懸案 被告免賠

（中央社記者蔡沛琪台北2日電）台北市吉林茶行命案被告劉昭源等遭台北地檢署求償犯罪被害補償金。台北地院指他們獲判無罪確定，非犯罪行為人，北檢敗訴。

法院判決指出，天道盟太陽會會長、綽號「世將」的方世祥於民國89年間在吉林茶行遭人槍殺身亡。檢警認定全案是幫派內訌，依殺人罪嫌起訴天道盟分子劉昭源、開車接應的林宗堯，涉案的劉士維則遭通緝逃亡中。

台灣高等法院認定目擊證人證詞有瑕疵，判決劉昭源、林宗堯無罪，案經最高法院駁回上訴確定，吉林茶行命案成了懸案。

北檢在案發後依法補償死者方世祥的父母近新台幣64萬元，轉而提起民事訴訟向劉昭源、林宗堯求償。但台北地院審理後認為，兩人獲無罪確定，並非犯罪行為人，也非犯罪被害人保護法規定負有賠償義務的人，因此判決北檢敗訴。全案可上訴。1030302
