工地土崩1死 包商、主任判刑

去年8月甲仙區連日雨，當地土質鬆軟，工人鍾達鑑在台20線聖道橋附近施作擋土牆修復工程時，幾乎被崩落的砂土活埋，送醫不治。法官判潘姓工地主任有罪，鍾姓承包商也須負責，依違反勞工安全衛生法判6個月徒刑，可易科罰金。

判決指出，100年7月底高雄山區連日降雨，鍾姓工人到甲仙區台20線附近施作工程，當時開挖面的土壤因飽含水分，乘載力不足，他被命令在5公尺深的工地察看，現場沒有任何擋土支撐。鍾姓工人查看時，上方砂土突然崩落，將他掩埋，剩左手露出。

現場工人和消防人員將他救出時，鍾姓工人已經沒有心跳。潘姓工地負責人被判刑8個月，緩刑3年。黃姓工人證稱，事發前多次由監造人員告知鍾姓負責人，告知現場沒有按圖施作擋土牆設施，是涉及工程安全的重要事項，要找承包商謀補救措施，再決定要不要進行後續工程。
