【陳嘉恩／台北報導】氣象局指出，今天東北風稍微增強，迎風面的北部及東半部地區有局部短暫陣雨，氣溫也略降1到2℃，各地高溫約30到33℃，低溫在23到25℃，早晚感覺有涼意；中南部較不受影響，高溫仍在32到33℃左右，午後可能有雷陣雨。

至於輕度颱風「萬宜」距離台灣1380公里，持續朝日本前進，對台灣天氣並沒有直接影響。不過氣象局預測，未來幾天在太平洋的大低壓帶裡可能有新的熱帶系統生成，強度不排除會達到颱風，並往西移接近台灣；周三開始水汽就會增加，周四起的中秋假期，台灣附近易受熱帶系統影響，天氣較不穩定。由於新的熱帶系統目前尚未形成，未來發展還有變數，但適逢中秋假期，氣象局會持續密切注意，也提醒民眾留意最新天氣動態，安排出遊行程要有雨天備案。

【陳俐妏╱台北報導】高盛證券出具汽車產業報告表示。新一代日產Nissan Sentra 10月有望搶市，看好Nissan OEM廠商可望受惠裕隆(2201)，但和泰車(2207)在Toyota Coroll市占有流失的狀況，加上國瑞汽車的競爭，獲利可能有風險。
 
高盛證券指出，Nissan樂觀看好Nissan Sentra單月銷量上看1000輛，不過高盛證較保守預期，新車單月銷售有望達500輛，裕隆(2201)仍可受惠新車題材，給予買進評等，並將目標價從60元上調至64元。
 
不過高盛證券也指出，中國市場Nissan Sentra接受度有好評，但豐田Toyota Corolla去年市佔有流失的狀況，這樣的趨勢可能延續到台灣市場，加上國瑞汽車的競爭，對和泰車(2207)獲利將有影響，維持賣出評等，但考量Altis預售情況，調升今年每股獲利1%。

「九月政爭」發展至今，立法院長王金平之資格因台北地院作成獲准保留其黨籍之假處分而暫告確保。唯就憲法而論，具不分區立委身份之院長倘若喪失黨籍，是否即失去院長資格？此一攸關權力分立憲政秩序維繫的憲法疑義，仍亟待釐清。
 
民主政治就是政黨政治，國會本是多元意見折衝、協調場域。院長係由立委共同互選而來，其法定職責在於折衝、協調各方意見，秉持公平中立原則，維持國會秩序，處理議事，並綜理院務，地位超然。若認具不分區立委身分之院長一旦喪失黨籍，即失去院長資格，此種見解不啻意味總統、行政院長乃至於任何人若支配該黨，則同黨籍的立法院長旋將淪為聽其擺佈的奴僕。這種情況下，試問對立院院長維持議事中立的憲法誡命，應如何維持？國會制衡行政權之憲政機能，該如何發揮？有學者雖稱「九月政爭」尚無憲政危機，從憲法學觀點視之，此見解有待商榷。
 
立院院長最重要的功能在於：讓立院裡複數對立的意見，於議事過程裡都能被一視同仁、平等對待，確保分歧意見經公平、公正地討論妥協下，最後再依「多數決原理」進行價值抉擇。為統整各方意見，並維持議事順暢，立院院長本應超然公正，殊難一昧迎合所屬政黨的政治偏好與具體黨紀指令。憲法對立院院長超然公正之要求，應不下處理個案審判的法官。基於「舉輕明重」法理，筆者認為立院院長更應超出黨派以外，依法律並本於國會自治原則行使職權，不受任何干涉。
 
再者，參照釋字第331號意旨，全國不分區民代既非由區域選民選出，自無從由原選區選民罷免之。憲法第66條既已明定立院設院長、副院長各一人，由立委互選。稟持同旨，立院院長既非由政黨指派，而係由立委互推而來，其法律地位迥異於一般不分區立委。縱令有不適任之情事而有迫其去職的必要，程序上也應依憲法第66條規定，由立委互選繼任院長取代，如此方符議會民主制度對國會議長超然公正性要求之憲法本旨。豈容身兼該黨主席身分之現任總統，藉由對考紀會的「實質影響力」，恣意以撤銷黨籍手段，輕率拔除之？
 
本件訴訟未來不管如何演變，此一憲政疑義終將難以迴避。為維持憲法秩序，並及時保護普通法院免於陷入政治漩渦，一旦有人提出釋憲，素有「憲法守護者」美稱的大法官們，該是勇於接招的時候了！
